- V. 5. MALISE, EARL OF STRATHEARN [SCT], son and heir, was, about August 1244, one of the guarantors of Alexander II's confirmation of the pact of 1237. He was present in Parliament [SCT], February 1244/5, and took an active part in the Coronation of Alexander III at Scone, 13 July 1249. Supporting the English party in the change of government in 1255, he was appointed P.C. [SCT] and one of the Regents of Scotland and Guardians of the King and Queen [SCT] for 7 years from 14 September. On 28 March 1258 he was summoned to serve against Llewellyn, Prince of Wales, by the King of England, who, in April following, directed him to attend in person on his daughter, the Scottish Queen. He had licence to go beyond seas, 4 May-1 August 1259; and was a considerable benefactor to Inchaffray Abbey.
He married, in or before 1244, Marjory, daughter and coheir of Robert DE MUSCHAMP of Wooler (died 1250), by his wife Isabel (who married, 2ndly, Richard MORIN). She, who was said to be aged 24 in 1250, was living circa 13 October 1251, but died s.p.m. before 20 March 1254/5. He married, 2ndly, before 12 December 1257, Maud, da. of Gilbert, EARL OF CAITHNESS AND ORKNEY [SCT]. He married, 3rdly, in or before 1261-62, Emma, whose parentage is not recorded. She was living, 13 October 1267. He married, 4thly, circa 1268, Mary, widow of Magnus, KING OF MAN (died 1265), daughter of Ewen of Argyll. He died (before 23 November) 1271, it is said in France, and was buried at Dunblane. His widow married, 3rdly (post nuptial dispensation 5 April 1281), Sir Hugh ABERNETHY of that Ilk, who died between 28 June 1291 and 10 February 1291/2. She married, 4thly, as his 2nd wife, before 10 April 1299, William FITZWARIN, who died before 1 December following and was buried in the church of the Grey Friars, London. M.I. Notes for Malise of Strathearn:
Earl of Caithness; 20th Earl of Orkney; last hereditary earl of Orkney c 1329 to abt 1353.
He succeeded his distant cousin Magnus V, both of whom claimed descent from Earl Gilbert. He was the son of the earl of Strathearn and his life revolved more around that responsibility than his Orcadian inheritance. He was involved in the intrigue between the courts of England and Scotland and was twice accused of treason. By his reign the earldom had lost any independence it once held and, though still subject to the kings of Norway, was for all practical purposes part of Scotland. The exact date of Malise's death is not known, but was probably around 1353. The earldom passed to his son-in-law Erengisl.
